These Terms of Service ("Terms") govern your use of the TikTok Comment Sales-Lead platform operated by NKStudio (Enterprise No. K2020518335), 221 Reaphila, Lenasia South, Grasmere, Gauteng, 1833, South Africa ("NKStudio", "we", "us"). By creating an account or using the Service, you agree to these Terms.
NKStudio provides an automated platform that monitors publicly visible TikTok video comments, filters them based on user-defined keywords, and forwards qualifying comments as leads to connected CRM platforms including HubSpot and Zendesk.
You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your organisation. By using the Service, you represent that you meet these requirements.
You agree to use the Service only for lawful purposes. You may not use the Service to:
You are solely responsible for ensuring your use of lead data complies with applicable marketing, privacy, and consumer protection laws.
The Service accesses publicly visible TikTok comment data. You acknowledge that:
Subscriptions are billed monthly in advance. By subscribing to a paid plan, you authorise NKStudio to charge your payment method via Paystack on a recurring monthly basis until you cancel.
Each plan includes a defined number of active campaigns. You may not exceed your plan's campaign limit. Exceeding limits will be enforced automatically by the platform. The maximum campaign limit across all plans is 40 campaigns.
The Service, including its software, design, and documentation, is owned by NKStudio and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.
To the maximum extent permitted by applicable law, NKStudio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim.
You agree to indemnify NKStudio against any claims, losses, or damages arising from your violation of these Terms, your use of lead data, or your breach of applicable laws.
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party platform changes, or force majeure events may affect availability. We will provide reasonable notice of planned maintenance where possible.
We reserve the right to suspend or terminate your account for violation of these Terms, fraudulent activity, or abusive use of the platform. You may terminate your account at any time from your account settings.
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
We may update these Terms from time to time. Material changes will be communicated to registered users by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
